Tribunal decision is due the struggle for gay adoption

The 10th U.S. Circuit Court of Appeals, whose headquarters is located in Denver, it is expected that the rule this spring, if a state should honor to homosexual adoption in other countries. The time is certainly the case with regard to the apparent determination of the General Assembly on the Colorado, a law that would allow homosexual couples to use a two-step procedure for adopting children. House Bill 1330 has already home and looked on action in the Senate.

Just last year, Colorado voters rejected a referendum, I would have national partnerships and allows homosexual couples the same adoption rights of heterosexual married couples. Colorado current law contains no provision for homosexuals only lock a petition for adoption, but a Colorado Supreme Court Bar-stop homosexual couples, which is what is commonly called the parents of stage or Second parent company adoption. HB 1330 would be about this decision.

The case argues that, last year before November 10 Circuit handles the biggest question is whether the adoption approved in a state should be recognized in another area.

Oklahoma status since 2004, which stipulates that the State and its authorities and the courts can not recognize an adoption by more than one person of same sex from any other state or foreign jurisdiction. ”

This law was after the coup Prosecution Service decided that Oklahoma has issued a new birth of the child adopted by two men from Washington State. These two men and two lesbians couples challenged the new law and a U.S. District Court judge decided that under federal law full faith and credit clause that the State of Oklahoma had the honor of the adoption by homosexual couples in other countries.

The clause of the lower court is as follows: “Full faith and credit are available in each state, deeds, records and judicial proceedings of every other State.” The clause is not as easy as it may seem. Congress itself the Defense of Marriage Act, which expressly provides that the State should recognize a same-sex marriage in another state, not a right or an honour to receive this relationship.

It has long been a tactic of gay rights groups to a success in a city or state and use as a means of pressure elsewhere.

Only recently, gay rights defender obtained a Supreme Court decision in New York in Westchester County, in possession of the county to recognize same-sex marriages, the public authorities. Efforts are already underway for the same result elsewhere.

The case concerns adoptions Oklahoma, Washington, California and New Jersey. The objective is not only a judgement, that the status of the barrier on the recognition of same-sex adoptions is unconstitutional. The goal is ultimately a decision by the 10 Circuit, beyond, Oklahoma and help define the principle that all states must honor Out-of-State adoptions, including those of same-sex couples.

It is not difficult to guess what would be the result. Once a state is forced to recognize such regimes, it is very difficult to refuse permission for such adoptions.

If the law of 1330 HP in Colorado, it is only a matter of time before the effort begins to change the law once again. It becomes quickly asserts that homosexual couples should not be forced to adopt, in a two-step process, first, and then another, trying to establish a decree adopted. Every time that victory is achieved, the application is made quickly, that the ban on homosexual marriage is irrational because it is inconsistent with the law, a treatment different from that of married homosexual couples the same fully involved.

Now, it can be made good arguments for such a course, similarly, there are already some good arguments against. But it is absolutely not a good argument for renting courts were entitled to a treasure hunt by groups of interest to produce cultural, religious and social changes, without the full participation and approval of a public informed.

The 10 Circuit cases, part of efforts by gay rights groups to circumvent lawmakers and the public - and that is why the public should pay special attention to the judgement of the Court of Justice.
